According to the Curia's uniformity decision, in damages lawsuits over competition law infringements (cartels) the statutory presumption only concerns the extent of overcharging. The injured party therefore still has to prove that actual damage occurred. The case arose from the truck cartel established by the European Commission in 2016, and the Curia set aside an earlier contrary judgment of its own and ordered a new procedure.
